Terms of Service

Last updated: 8 September 2026 · Versión en español

These terms govern the use of Samán, the procurement platform operated by Samantech (Colombia). By creating an account or using the service, the customer company and its users accept what follows.

Samán is a business-to-business service. It is not directed at consumers or at minors.

1. What the service is

Samán lets a company run its procurement process: recording internal purchase requests, requesting quotes from its suppliers by email and over WhatsApp, reading and comparing the responses, and keeping a record of approvals and of the resulting purchase orders.

Part of the processing — reading quotes and classifying messages — is done by third-party language models. How that works and what data it involves is set out in the privacy policy, which forms part of these terms.

2. Accounts and users

The customer company is responsible for who it grants access to, for the roles it assigns them, and for keeping its credentials secure. Each user is accountable for activity on their own account.

The customer company must notify us without delay if it suspects unauthorized access.

3. Acceptable use

The customer company and its users undertake not to:

4. Messages to suppliers

The messages belong to the customer company, not to us. Samán sends them on its behalf, and always after a person at that company confirms them. There is no automatic sending without human approval.

Accordingly, the customer company is responsible for having a legitimate business relationship with the suppliers it writes to, for the accuracy of the phone numbers and email addresses it uploads, and for the content of the messages.

Where messages go out over WhatsApp, the customer company must also comply with the Meta policies applicable to the WhatsApp Business Platform, including its Business Messaging Policy. A breach of those policies may lead Meta to restrict the customer company's phone number or account, which is outside our control.

The customer company authorizes Samantech to connect and operate its WhatsApp Business account — registering and reading message templates, reading the status of its phone numbers, and sending and receiving messages — for the sole purpose of providing this service.

5. Who owns the data

The data the customer company uploads to or generates in Samán — suppliers, purchase requests, quotes, conversations and purchase orders — belongs to that company. Samantech processes it as a data processor, in order to provide the service, in accordance with the privacy policy.

The customer company may request a copy of its data, or its deletion, at any time by writing to the address in section 11.

6. Availability and changes

We work to keep the service available and working well, but we do not offer a guaranteed service level unless one is agreed in writing in a separate agreement. There may be interruptions for maintenance, because of failures at third parties we depend on, or for reasons outside our control.

Samán is under active development: we add, change and sometimes retire functionality. Changes that significantly affect use of the service are announced with reasonable notice.

7. Commercial terms

Price, payment terms, duration and any service-level commitment are agreed in writing with each customer company in a separate agreement. Absent a written agreement, access is understood to be granted as a trial or pilot, free of charge and with no commitment to continue on either side.

8. Intellectual property

The software, the Samán brand and everything that makes up the platform belong to Samantech. These terms grant the customer company a limited, non-exclusive and non-transferable right of use for as long as the account is active — they transfer ownership of nothing.

What the customer company uploads remains its own, as stated in section 5.

9. Limitation of liability

Samán is a tool that supports a procurement process. Purchasing decisions, approvals and the orders that result from them belong to the customer company, including where they rely on recommendations or on data extracted automatically from a quote. The service can misread a document; that is why every action with an effect requires human confirmation.

To the extent permitted by law, Samantech is not liable for lost profits, lost opportunity or indirect damages, and its total liability to the customer company is limited to the amount that company has paid for the service in the twelve months preceding the event giving rise to the claim.

10. Termination

Either party may end the relationship at any time on written notice. Samantech may suspend access immediately where there is use that breaches section 3 or that puts the service or third parties at risk.

When an account is closed, data is retained and deleted according to the period in the privacy policy: up to 90 days after closure.

11. Governing law and contact

Samán is a service of AGMO S.A.S., a Colombian company trading under the name Samantech, tax ID (NIT) 900.474.780-5.

These terms are governed by the laws of the Republic of Colombia, and any dispute is submitted to the competent courts of Colombia.

12. Changes to these terms

If we change these terms, we update the date in the header and publish the new version at this same address. Substantive changes are also communicated to customer companies. Continuing to use the service after a change means accepting it.
